Customer Purchase Agreement

By processing your pending order through the utilization of a credit card, money order, or personal check, YOU AGREE THAT YOU HAVE ENTERED INTO A LEGAL AND ENFORCEABLE ONLINE CONTRACT WITH VLYME and accept the terms and conditions set forth in this Conditions of Use and Sale to govern your pending transaction with Vlyme.

DISCLAIMER, RELEASE, ASSUMPTION OF RISK, WAIVER OF LIABILITY AND INDEMNITY AGREEMENT

Vlyme is not responsible for any physical harm or damage from the use or misuse of any of our products.

By purchasing any product from us, you understand that Vlyme does not warrant that you may legally purchase, possess, or carry these products according to any state, federal, or local laws. You also acknowledge that you have determined their legality before purchasing and that you are an adult of at least 18 years of age and under no legal disability.

By purchasing any product from Vlyme, the buyer warrants that he/she is in compliance with all applicable federal, state, and local laws and regulations regarding the purchase, ownership, and use of the item. The buyer expressly agrees to indemnify and hold harmless Vlyme for all claims resulting directly or indirectly from the purchase, ownership, and use of the item in compliance or violation of federal, state, and local laws or regulations.

ADDITIONAL TERMS

1. Age & Eligibility Verification

  • You represent that you are at least 18 years of age (or the legal age of majority in your jurisdiction, if greater) and legally eligible to purchase self‑defense devices.

  • You agree to provide truthful and accurate information to satisfy any age or identity verification we may require.

2. Prohibited & Restricted Jurisdictions

  • Permit‑Required U.S. States: Connecticut, Delaware, Illinois, New Mexico, West Virginia, Wisconsin. Orders to these states require a valid, legible copy of the purchaser’s local permit or license prior to shipment.

  • International Destinations We Do NOT Ship To: Australia, Canada, China, Finland, Germany, Hong Kong, Iceland, Ireland, Japan, South Korea, Sweden, United Kingdom, Russia, and any country where import of conducted‑energy weapons is prohibited or requires a special government license.

  • Right of Cancellation: We reserve the right to cancel and refund any order that violates, or appears to violate, any applicable law or our compliance policies.

3. Customer Responsibilities & Certification

By completing checkout you certify that:

  1. You have personally verified that possession and use of the item is legal in your shipping destination.

  2. You have obtained all required permits or licenses.

  3. You will use the product solely for lawful self‑defense purposes.

  4. You will not export, re‑export, or transfer the product contrary to U.S. export laws, including the Export Administration Regulations (EAR).

4. Shipping, Risk of Loss & Title

  • Title and risk of loss pass to you upon our delivery of the products to the carrier.

  • You are responsible for any customs duties, import taxes, seizures, or penalties arising from the shipment.

5. Limitation of Liability

  • To the fullest extent permitted by law, Vlyme shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of profits or data, arising out of or related to your purchase or use of our products.

  • Our aggregate liability shall not exceed the purchase price you paid for the product giving rise to the claim.

6. Indemnification

You agree to defend, indemnify, and hold harmless Vlyme, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • Your breach of these Terms;

  • Your violation of any law or the rights of a third party; or

  • Your purchase, ownership, or use of any product.

7. Governing Law & Dispute Resolution

  • Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict‑of‑law principles.

  • Arbitration: Any dispute arising out of or relating to these Terms or your purchase shall be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Dallas County, Texas. You waive any right to participate in a class action.

8. Severability & Entire Agreement

If any provision of these Terms is held unenforceable, the remaining provisions shall remain in full force and effect. These Terms constitute the entire agreement between you and Vlyme regarding your purchase and supersede all prior or contemporaneous communications.

9. Updates to Terms

We may modify these Terms at any time by posting the revised version on this site. Changes apply to all orders placed after the effective date of the updated Terms.
